Compensation Not Allowed
In some cases, victims of an accident are not allowed to claim compensation. If the vehicle involved in causing an injury is stationary, and is not on a public highway, you cannot claim compensation for any injury caused by the vehicle. Where an injury is caused by a snowmobile, or any other vehicle not intended for use on a public highway, you may not claim compensation, and you cannot claim compensation if you are injured as a result of an automobile race, even if the race takes place on a public highway where the highway has been closed to the public for the duration of the event.
Death Benefits
If an automobile accident causes the death of a victim and the victim is married, the victim's spouse may be entitled to a lump-sum payment. The amount of the lump sum payment depends on the age of the victim and the amount of compensation entitlement that the victim would have received if the victim had survived the accident. The amount of the entitlement is multiplied by a figure contained in a schedule forming part of the act. For example, if the victim is aged 30, the victim's entitlement is multiplied by two, to arrive at the lump-sum amount payable to the victim's spouse.
